The Senior Director, Counsel – Market Access Litigation, Legal Policy and Strategy is for a creative, curious, and strategic litigator with impeccable judgment and experience at the intersection of law and policy. This role focuses on litigation, policy engagement, and other advocacy to shape the legal and regulatory rules that govern how Lilly’s medicines are priced, purchased, distributed, and reimbursed. The work sits at the center of the pharmaceutical supply and reimbursement ecosystem that facilitate patients’ access to Lilly’s medicines; and the federal and state laws that govern it. The successful candidate must be energized by an evolving legal and regulatory environment, learn dense and unfamiliar subject matter quickly, collaborate closely with legal and business colleagues, influence cross-functionally including with external stakeholders, and earn the trust of senior business and legal leaders. This position reports to the Associate Vice President, Assistant General Counsel – Litigation, Legal Policy & Strategy.

Basic Responsibilities:

  • Develop and execute strategy — and advise senior leadership and the business — on litigation, policy engagement, and other advocacy addressing the laws, regulations, and industry trends that shape drug pricing, access, and reimbursement.
  • Proactively identify and assess potential new affirmative litigation and advocacy opportunities to advance Lilly’s market-access and pricing policy.
  • Provide litigation counsel to Government Affairs, Communications, Regulatory Affairs, Lilly Value and Access on legal policy and strategy priorities, including drafting and reviewing communications, comment letters, and related materials.
  • Manage litigation, government investigations, and other disputes across the portfolio from strategy through resolution.
  • Lead and manage outside counsel, including the development and oversight of reasonable budgets, and coordinate internal efforts to deliver results within them.
  • Engage with key external parties — government agencies, state attorneys general, trade associations, industry, and the outside policy and counsel network — to ensure Lilly’s legal policy interests are represented and advanced.
  • Build and maintain relationships across Lilly’s legal and business functions. Collaborate closely with Lilly’s policy and Market Access legal and business teams to advance Lilly market access strategies.
  • Monitor and analyze litigation, enforcement, and policy developments affecting drug pricing, access, and reimbursement.

Qualifications:

  • Bachelor’s degree and J.D.
  • Active license to practice law in one of the 50 states.
  • A clerkship on a federal court of appeals.
  • A minimum of 8 years of experience as a practicing attorney, including managing complex litigation and developing and executing strategy at a global company and/or top law firm.
  • 8 plus years experience of success in complex litigation at both the trial and appellate levels — including taking matters through discovery, dispositive motions, and trial, and briefing and arguing appeals.

Additional Skills/Preferences:

  • Experience litigating constitutional claims, statutory and regulatory challenges, and APA matters.
  • Strong client-service orientation and executive presence, including the judgment, poise, and clarity to advise senior leaders and represent the Legal function credibly.
  • Highly motivated and collaborative partner with strong interpersonal skills and the ability to work effectively with team members, other lawyers, and management across all levels of the company.
  • Demonstrated experience engaging on complex policy issues and proven ability to master complex new subject matter quickly and exercise sound judgment before becoming a subject-matter expert.
  • Experience litigating class actions, matters involving state and federal healthcare programs (e.g., Medicare, Medicaid, 340B), and fraud and abuse laws (e.g., AKS and False Claims Act).
  • Experience managing litigation within the pharmaceutical or another highly regulated industry.
  • A genuine eagerness to learn about — and to improve — the pharmaceutical supply and reimbursement ecosystem.
  • Enthusiasm for harnessing artificial intelligence and emerging technology to litigate and practice more effectively.
  • Demonstrated leadership and effectiveness in working with senior leadership.
  • Demonstrated ability to appropriately handle highly confidential information.

Actual compensation will depend on a candidate’s education, experience, skills, and geographic location.  The anticipated wage for this position is

$195,000 - $314,600

Full-time equivalent employees also will be eligible for a company bonus (depending, in part, on company and individual performance).
