Toast creates technology to help restaurants and local businesses succeed in a digital world, helping business owners operate, increase sales, engage customers, and keep employees happy. We are hiring a motivated and detail-oriented Associate Counsel to join our Legal team. 

As Associate Counsel, Product and Marketing, you will be a partner to your business colleagues and advise multiple Toast teams including product, engineering, marketing, compliance, and sales teams. You will learn Toast's products, strategies, and processes, and help the business identify and mitigate legal risk while helping Toast grow and evolve.

Our Legal & Compliance teams are primarily concentrated in Boston, New York, Washington D.C., San Francisco, and Chicago. Candidates residing in these areas will be prioritized, as they will benefit from closer proximity to colleagues and greater access to company resources and events.


A day in the life (Responsibilities) 

  • Supporting legal team members in advising stakeholders across the product, engineering, and marketing teams, from early product development through launch, including the review of marketing strategies and assets.
  • Performing first-pass review of advertising and marketing collateral, including claim substantiation, disclosures, promotions and sweepstakes, and endorsements and testimonials.
  • Supporting the review of hardware product development, identifying legal risks in areas such as product labeling and regulatory certifications.
  • Supporting Toast's trademark portfolio development and enforcement efforts, including investigating potential third-party infringement, preparing cease-and-desist letters and takedown requests, and tracking matters through resolution.
  • Researching and summarizing U.S. and international laws and regulations relevant to the Toast platform, products, services, and marketing activities.
  • Helping maintain and improve scalable processes for providing legal input to business partners, such as review checklists, templates, FAQs, and intake workflows.
  • Working collaboratively across functions to build an understanding of how Toast products work and how applicable laws and regulations shape their development.
  • Managing your own deliverables, communicating clearly on routine matters, and collaborating with other legal team members as needed.

What you'll need to thrive (Requirements)

  • A J.D. from an ABA-accredited U.S. law school, and membership in good standing to at least one state bar.
  • 3-4+ years of legal experience, preferably advising corporate and commercial entities.
  • Familiarity with marketing and product-related laws and regulations, and with core privacy concepts.
  • Experience supporting the review of advertising and marketing collateral, or a strong interest in developing it.
  • Exposure to trademark matters, such as clearance, enforcement, or prosecution support, or to hardware or consumer product compliance, is a plus.
  • Experience working with fast-paced technology, software, or fintech companies is a plus.
  • A strong eagerness to learn and detail-oriented focus.
  • A solution-oriented, customer service, and growth mindset, with the ability to apply established legal frameworks to novel business concepts.
  • Strong communication skills and the ability to explain legal concepts clearly to a non-legal audience.
  • The ability to work well with cross-functional teams, manage multiple projects with supervision, and recognize when to escalate.

The base salary range for this role is listed below. The starting salary will be determined based on skills, experience, and geographic location. In addition to base salary, our total rewards components include cash compensation (overtime, bonus/commissions if eligible), equity, and benefits. You can learn more about how we align pay with local labor markets in our Geographic Pay Zone Philosophy.
