What you will do 

As an integral member of the legal team, you will partner closely with the Human Resources organization to provide employment and HR-related legal services and advice in support of executing Vangst’s employment policies and practices.  This will include legal services such as advice and counsel on the full range of employment issues (employment discipline, policies, leaves and accomodations, investigations, etc.), optimizing litigation results (agency, individual, and class action), and provide employment law training/skills development.  You will also provide hands-on legal counsel to all levels of the organization, be responsible for identifying and analyzing legal issues, drafting key documents (Master Services Agreements, Statements of Work, Strategic Alliance Agreements, Partnership Agreements, etc.), presenting clear recommendations, and ensuring legal compliance.

Essential Duties and Responsibilities 

  • Oversee the full scope of labor and employment law advising and support to Vangst by advising on the full scope of U.S. federal and state employment and anti-discrimination laws including but not limited to FLSA, ADA, ADEA and the corresponding enforcement agencies. 

  • Become a trusted advisor to the business and serve as the primary legal support for day-to-day employment and HR-related legal matters.

  • Work with human resources team to evaluate current employment practices, policies, and processes to assess and execute priorities, and ensure compliance.

  • Partner with human resources team to investigate and respond to internal complaints, demand letters, legal complaints, administrative complaints, audits, and other employment-related inquiries.

  • Oversee labor and employment litigation matters, both through in-house responses and management of outside counsel. 

  • Oversee and review all policy manuals, severance reviews, MSA agreements, etc.

  • Provide advice and counseling on a broad spectrum of employment law issues, including: recruiting, employee relations, performance management, leaves of absence and accommodations, wage and hour, internal investigations, compensation and benefits, privacy, and contingent workforce issues.

  • Coordinate response to charges from state and federal agencies, including subpoenas and similar requests for employment-related records.

  • Keep general managers and HR informed of significant labor and employment trends and decisions, legislation and rulings.

  • Manages both employment and general litigation matters, including recommending outside counsel, developing case strategies and budgets, discovery responses, deposition preparation of client, and final favorable resolution.

  • Analyze and recommend strategies and/or practical solutions to achieve business goals while maintaining acceptable level of risk.

  • Reduce external counsel expenditures where appropriate, particularly regarding employment matters.

  • Ensures compliance with all applicable laws, rules and regulations.

  • Provide training to company business partners on various contracting, risk management, legal, and compliance topics. 

What you’ll need to be successful in this role  

  • J.D. degree from an accredited U.S. law school.

  • 3-5 years of relevant experience required.

  • Active member of a state bar in good standing.

  • 3+ years employment law experience, preferably with experience in California and Massachusetts.

  • 2+ years experience with contract law, specifically with MSAs.

  • Experience in California Employment law highly preferred.

  • Substantial knowledge, expertise, and experience in labor & employment law.

  • In-depth knowledge of U.S. federal and state employment laws and regulations including NLRA, SCA, FLSA, Title VII, Americans with Disabilities Act, Family Medical Leave Act, EEO laws, wage and hour and other federal and local laws affecting the employer-employee relationship and federal and state prevailing wage laws.

  • Extensive experience developing strong partnerships with business leaders.
